Data Request Guidelines for Law Enforcement

At Postmates, we appreciate the hard work law enforcement provides to our company and the communities we connect. We’re also committed to ensuring the safety, security, and privacy of our customers, merchants, and fleet. As part of this commitment, we store and maintain private and personally identifying information (PII) as described in our Privacy Policy and Terms of Service.

The following guidelines should assist law enforcement or other government agencies seeking records from Postmates.

 

Requests from Law Enforcement

For requests that do not involve an immediate risk of death or serious bodily injury, please provide written consent from the individual about whom you seek records; a valid and duly issued search warrant;  or, if applicable, a court order that includes:

  • The name of the issuing authority;
  • Badge/ID number of the responsible agent/officer;
  • Direct contact information;
  • Clear grounds for the legal basis of the request;
  • Details of the specific information requested and its relationship to your investigation;
  • All known email address(es), name(s) or alias(es), known physical address(es), telephone number(s), and/or credit card account information of the subject for whom you're seeking information.

Law Enforcement can serve documents on Postmates via CT Corporation, our registered agent for service of process. Additionally, for your convenience and a faster turnaround, please email a courtesy copy to our law enforcement request team at LER@postmates.com. Please understand that our acceptance of legal process does not waive any legal objections Postmates may raise in response to a request.

Emergency Disclosure Requests

For disclosure requests that involve an immediate risk of death or serious bodily injury, in accordance with our Privacy Policy, Postmates may disclose information to law enforcement without service of a search warrant or court order. Postmates evaluates emergency disclosure requests on a case-by-case basis and in compliance with applicable law.  

Emergency disclosure requests must include all of the following:

 

  • “Emergency Disclosure Request” identified in the subject line of the request;
  • Identity of the person in immediate risk of physical harm;
  • Nature of the emergency;
  • A detailed description of the specific information requested and why that information is necessary to prevent the emergency;
  • All other available details or context regarding the particular circumstances.

 

Law Enforcement should direct emergency disclosure requests to LER@postmates.com and PMLegal@postmates.com.

 

Notice to Subject of Request

Unless otherwise prohibited by law, Postmates may notify customers, merchants, or fleet members of law enforcement requests before producing PII. Law enforcement officials who do not want their request disclosed should provide an appropriate court order, other information establishing that notice is prohibited or would otherwise be counterproductive and/or unsafe, or sufficient detail for Postmates, in its discretion, to determine whether a request falls into one of the exceptions above.
